Electrical Contest Terms and Conditions

Article 1: Principle

These competition rules set out the regulations governing the conditions of participation in the non-mandatory competition to win the prizes mentioned in Article 5. (hereinafter the "Electrical Contest").

This Electrical Contest is organised by TVH Parts NV, with registered office at Brabantstraat 15, 8790 Waregem, Belgium (hereinafter the "Organiser").
By participating in the Electrical Contest, the Participant (as defined below) accepts without reservation or restriction all provisions of these competition rules and the decisions of the Organiser.

Article 2: Who can participate?

Participation in the Electrical Contest with purchase obligation is exclusively reserved for organisations with a VAT number (or similar, being a tax/company number in the relevant country to identify the Participant) (hereinafter the "Participant").

The natural person placing the order is not personally eligible for a prize.

Article 3: Modalities of participation

The Participant will receive a "ticket"/"opportunity" to participate in the Electrical Contest (hereinafter a "Ticket"), if the Participant:

  • registers on the website [*],
  • answers the knowledge question correctly, and
  • fills in the tie-breaker question.

In order to validly register, the Participant must:

(a) fill in the following data: email, company name, TVH account number,
(b) answer the knowledge question correctly (How many categories does our electrical range include?); and finally
(c) fill in the tie-break question (How many solar panels does TVH Parts have globally?).

The Participant guarantees that the communicated data and information is correct, up to date and complete.

Any incomplete participation and any participation that has not been submitted via the mentioned website will be declared null and void.

The activation of the Ticket (and the effective participation in the Electrical Contest) is done by the purchase of electrical parts via the webshop MyTotalSource (EMEA/APAC) or IRMN (Americas) or by telephone via the Organiser's sales service and this for an aggregate value of at least:

  • for Participants not located in Asia or Oceania: TWO HUNDRED AND FIFTY EURO (€ 250, 00) excl. VAT (or this amount converted into one of the following currencies: GBP, USD, TRY, ZAR, PLN, RUB (total amount excluding VAT);
  • for Participants located in Asia: TWO HUNDRED AND FIFTY SINGAPORE DOLLAR (SGD $ 250,00 -) excl. VAT,  ONE HUNDRED AND EIGHTY US DOLLARS (USD $ 180,00 -) excl. VAT, or ONE HUNDRED AND SIXTY EURO (€ 160, 00) excl. VAT; (or equivalent Tax charge f.e. GST)
  • for Participants located in Oceania: TWO HUNDRED AND FIFTY AUSTRALIAN DOLLAR (AUD $ 250,00 -) excl. VAT or TWO HUNDRED AND FIFTY NEW ZEALAND DOLLAR (NZD $ 250,00 -) excl. VAT; (or equivalent Tax charge f.e. GST)

over the time period of the Electrical Contest (as mentioned in art. 4).
(the aforementioned minimum aggregate values are hereinafter jointly referred to as the “Aggregate Value“)

The Organiser’s range of electrical parts is divided over 8 product categories:

(i) Electrical components
Resistors, potentiometers, transistors, thyristors, diodes, varistors, thermistors, electronic solder parts, inductors, programmed memory & more.

(ii) Electrical switches
Contactors, contacts, braids, and all electrical switches: emergency stop switches, pull switches, toggle switches, microswitches, limit switches, steering column switches ...

(iii) Batteries & chargers
Batteries, battery connectors, battery chargers, jump starters, battery regenerators & dischargers, battery watering systems, demineralization devices & many other battery related items.

(iv) Printed circuit boards & controllers
Accelerators, converters, printed circuit boards & many forklift electronics: speed limiters, lift truck weighing systems, camera systems, shock protection ...

(v) Joysticks
Electrical joysticks, controller boxes & hand controls

(vi) Electrical motor
Electric motors and all electric motor replacement parts, vacuum motors, brushes & brush holders.

(vii) Starters & alternators
Starters, alternators & dynamos

(viii) Lights & accessories
All types of industrial lights: work lights, front lights, rear lights, flashing beacons, LED strips, reflectors, bulbs …

Participants that over the time period of the Electrical Contest (as mentioned in art. 4) purchased electrical parts from at least four (4) different product categories and over the Aggregate Value, will have the chance to win a category 1 and category 2 prize; hence such a Participant will in fact have two (2) chances to win a prize. (starting from category 1, being the category of the main prize).

Note: a Participant located in Asia or Oceania is only eligible to win a category 2 prize; nevertheless if the Participant   purchased electrical parts from at least four (4) different product categories and over the Aggregate Value, such a  Participant will have two (2) chances to win a category 2 prize.

Participants that over the time period of the Electrical Contest (as mentioned in art. 4) purchased electrical parts from less than four (4) different product categories but over the Aggregate Value, will only have the chance to win a category 2 prize; hence such a Participant has only one (1) chance to win a prize.

There are TWO (2) category 1 prizes and TWENTY-TWO (22)  category 2 prizes to win.

The TWO (2) category 1 prizes are geographically allocated as follows amongst the Participants:

  • ONE (1) category 1 prize amongst the Participants from North and South America
  • ONE (1) category 1 prize amongst the Participants throughout the world, excluding North America, South America, Asia and Oceania

The TWENTY-TWO (22) category 2 prizes are geographically allocated as follows amongst the Participants:

  • FIVE (5) category 2 prize amongst the Participants from North and South America
  • ONE (1) category 2 prize amongst the Participants from France
  • ONE (1) category 2 prize amongst the Participants from DACH
  • ONE (1) category 2 prize amongst the Participants from IMET
  • ONE (1) category 2 prize amongst the Participants from Northern Europe
  • ONE (1) category 2 prize amongst the Participants from Benelux
  • ONE (1) category 2 prize amongst the Participants from Iberica
  • ONE (1) category 2 prize amongst the Participants from Africa
  • ONE (1) category 2 prize amongst the Participants from CIS
  • ONE (1) category 2 prize amongst the Participants from Eastern Europe
  • FOUR (4) category 2 prize amongst the Participants from Asia
  • FOUR (4) category 2 prize amongst the Participants from Oceania

Each Participant can obtain one (1) Ticket and, if applicable, activate it.

In the event that not all the conditions of the competition rules are met or in the event of abuse, deception, fraud or bad faith, the Organiser reserves the right to exclude the Participant in question from the Electrical Contest.
 

ARTICLE 4: TIME PERIOD

The Electrical Contest starts on Monday 6 September 2021 at 00:00 and ends on Thursday 30 September 2021 at 24:00. (CET / GMT+1)

Both obtaining a Ticket and its activation must take place within this period.

ARTICLE 5: THE PRIZE

Category 1 prize:  

  • a stock chaser representing a value of FIVE THOUSAND EIGHT HUNDRED US DOLLARS (USD $ 5.800,00 -) excl. VAT for the winner located in North or South America; 
  • an electric golf cart representing a value of EIGHT THOUSAND EURO (€ 8.000,00 -) excl. VAT for the winner located throughout the world, excluding North America, South America, Asia and Oceania

Category 2 prize: Electric scooter representing a value of THREE HUNDRED NINETY EURO (€ 390,00) incl. VAT

General conditions/restrictions with respect to the prize:

  • A Participant can win a maximum of one prize in this Electrical Contest. (Hence if a Participant wins a category 1 prize, he will no longer be eligible to win a category 2 prize.)
  • The prize is solely intended for professional use and therefore can only be utilised in a professional setting/environment (usage for private purposes is strictly prohibited).
  • The Organiser shall be entitled to verify the professional usage of the prize.
  • The prize may not be exchanged into gifts/cash or converted into cash in any way whatsoever through any channel.
  • A prize can only be awarded to the winner of the Electrical Contest and is therefore not transferable (including any sale) to any other person.
  • If unforeseen circumstances or circumstances independent of the Organizer's will, would make the delivery of a prize impossible; the Organizer reserves the right to award the relevant winner(s) with a voucher for the equivalent value. In such a case, this change of prize will be communicated by mail or telephone. Such change of prize shall not entitle the concerned winner to any compensation or indemnity.

Note: In some countries, the prizes are required to be registered (at public instances or other authorities) and a driver's license could be mandatory. The winner is responsible to obtain and  maintain all necessary registrations, licences, permits or other authorisations required under the applicable laws.

ARTICLE 6: DETERMINATION AND ANNOUNCEMENT OF WINNERS

In total there will be twenty-four (24) winners.

A winner is a Participant who, within the period specified in Article 4, cumulatively meets all the conditions of the Electrical Contest, that is:

  • The Participant must have correctly registered on the web page of the Electrical Contest by filling in his/her details and the requested mandatory information.
  • The Participant must have answered the knowledge question correctly and have answered the tie-breaker question correctly.
  • The Participant has purchased electrical parts via the webshop MyTotalSource (EMEA/APAC) or IRMN (Americas) or by telephone via the Organiser's sales service and this for at least the Aggregate Value over the time period of the Electrical Contest (when applicable, over four different product categories)
  • If no one answered the tie-breaker question correctly, the twenty-four (24) (or remaining) winners will be the Participants who answered the knowledge question correctly and whose answer to the tie-breaker question is closest to the correct answer.

The winner will in all events be appointed taking into consideration the number of different product categories of which electrical parts were purchased; hence the number of chances to win a prize and the category to win a prize in. (see article 3)

Mechanism of appointment of the winners: first appointment of the two winners of a category 1 prize and subsequently appointment of the winners of a category 2 prize. 
Note: a winner located in Asia or Oceania cannot win a category 1 prize. Hence a winner located in the aforementioned area will immediately win a category 2 prize.

In case of a possible ex aequo, the Participant who has bought the most electrical parts within the period mentioned in article 4, will be the winner.

The winners will be contacted personally by the Organiser (via e-mail or telephone) no later than the 18th of October 2021 in order to organize the handover of the prize. Note: all arrangements in light of the handover of the prize need to be in line with all local, regional and national governmental regulations in light of the pandemic caused by COVID-19.

The winners will also be announced via the Organiser's Facebook and LinkedIn page if applicable.

The result of the Electrical Contest is binding and irrevocable. The decision to designate winners is therefore final and cannot be contested.

ARTICLE 7: LIABILITY

The Organiser cannot be held responsible or liable for:

  • not being able to deliver a prize if the Participant provided insufficient, incomplete or incorrect contact details.
  • possible damage, physical injury or accidents that could occur as a result of winning a prize and/or participating in the Electrical Contest.
  • any shortcomings of the post and/or courier companies when delivering a prize (such as delay, damage, strike or loss).
  • any defect in the prize or if the prize doesn't meet the created expectations.
  • possible accidents, physical injury or damage (in)directly related to a prize won or the usage of a prize won.

The winner shall comply with all formalities, registrations and submissions in order to make usage of the prizes. The Organizer cannot be held liable for this.

The winner is responsible for all costs of maintaining the prizes to be fit for the purpose, and for compliance with all safety and legal requirements.

The Organiser shall make every effort to allow access to the website and the Electrical Contest at any time. The Organiser may interrupt access to the website and the Electrical Contest at any time, in particular for technical reasons, updates and maintenance. Under no circumstances can the company be held liable for these interruptions and their consequences.

ARTICLE 8: AMENDMENTS TO REGULATIONS 

The Organiser reserves the right to modify, suspend or revoke the Electrical Contest or its course at any time in any individual jurisdiction, if it is compelled to do so for legal reasons or if unforeseen circumstances or circumstances independent of the Organiser's wish justify this, without any right to compensation or indemnification in respect of the Participants.

If amendments to the regulations are made, these will be communicated to the Participants by email.

ARTICLE 9: APPLICABLE LAW & DISPUTES

These regulations are subject to Belgian law and will be implemented and interpreted in accordance with Belgian law.

The Organiser will see to the proper course of the Electrical Contest. All disputes concerning the application of these regulations shall be settled autonomously by the Organiser.

ARTICLE 10: PRIVACY

All personal data communicated by the Participants in connection with or within the framework of the Electrical Contest will be stored in a database managed by the Organiser. This personal data of the participants is thus processed by the Organiser.

This data falls under the application of the law of 30 July 2018 on the protection of individuals with regard to the processing of personal data and all Belgian regulations implementing the GDPR. The Organiser wishes to guarantee the private life of the Participant in compliance with all legal or other provisions relating to the protection of private life.

By participating, Participants agree that if they win a prize, they may appear on the website and other channels (such as YouTube, Facebook ...) with their picture, name and address, as well as on the website and online channels of any co-organisers, and in the written press, as well as be filmed for (television) coverage of the Electrical Contest.

This data can also be used for promotional campaigns or discounts, for information and for studies.

You may at any time consult the personal data processed by the Organiser, have all necessary corrections made or ask the Organiser, free of charge, to remove them from its files or not to communicate all or part of the information obtained to third parties.
