CONTEST RULES “SKIP THE LINE ORDER ONLINE F1”

These contest rules set out the regulations governing the conditions of participation in the non-mandatory contest to win the prizes mentioned in Article 5 (hereinafter the “SKIP THE LINE ORDER ONLINE F1”).

The SKIP THE LINE ORDER ONLINE F1 is organized by TVH Australia Pty Ltd, with registered office at 735 Boundary Road, Richlands, Queensland 4077, Australia (hereinafter collectively referred to as the "Organizer").

By participating in the SKIP THE LINE ORDER ONLINE F1, the Participant (as defined below) accepts without reservation or restriction all provisions of these contest rules and the decisions of the Organizer. The Participant (as defined below) additionally recognizes that all purchases are subject to the Organizer’s General Terms and Conditions of Sale, as available on its website: https://www.tvh.com/nl-be/terms-conditions.

Permit numbers will be displayed in the disclaimer of all related marketing material (flyers, advertisements, https://www.tvh.com/en-au) during the competition period. SA Permit number T23/19.

Participation in the SKIP THE LINE ORDER ONLINE F1 with purchase obligation is exclusively reserved for organizations with a GST number (or similar, being a tax/company number in the relevant country to identify the Participant) (hereinafter the "Participant"). The Participants must be located in Australia or Papua New Guinea.

The natural person who competes in the SKIP THE LINE ORDER ONLINE F1 is not personally eligible for a prize.

Persons under eighteen (18) years of age are not permitted to enter.

The Participant will receive a “ticket”/”opportunity” to participate in the SKIP THE LINE ORDER ONLINE F1 (hereinafter a “Ticket”), if the Participant places an order using the webshop E-Shop, MyTotalSource or TVH.agri. Every purchase order placed on E-Shop, MyTotalSource or TVH.agri grants the Participant a Ticket.

In order to validly register, the Participant must place a purchase order using the webshop E-Shop, MyTotalSource or TVH.agri during the month of F1.

Any incomplete participation and any participation that has not been submitted via webshop E-Shop, MyTotalSource or TVH.agri will be declared null and void.

The activation of the Ticket (and the effective participation in the SKIP THE LINE ORDER ONLINE F1) is done within the period mentioned in Article 4) by the purchase of any goods via the webshop E-Shop, MyTotalSource or TVH.agri.

Each Participant can only obtain ONE (1) Ticket and, if applicable, activate it. Because of the activation, the Participant has as much chance of a prize as he had Tickets (ONE (1) Ticket = ONE (1) chance of a prize).

In the event that not all the conditions of the contest rules are met or in the event of abuse, deception, fraud or bad faith, the Organizer reserves the right to exclude the Participant in question from the SKIP THE LINE ORDER ONLINE F1.

The SKIP THE LINE ORDER ONLINE F1 starts on Monday 13th of February 2023 (13/02/2023) at 12:00 AM and ends on Friday 10th of March (10/03/2023) at 24:00 PM (AEST, NZDT).

Both obtaining a Ticket and its activation must take place within this period.

Participants who have activated their Ticket have a chance to win:

• ONE (1) set of TWO (2) hospitality passes to ‘The Park’ (3-day pass) for Friday the 31st of March (31/03/2023), Saturday the 1st of April (01/04/2023) and Sunday the 2nd of April 2023 (02/04/2023) at the Melbourne Grand Prix (valued at approximately four thousand one hundred Australian Dollars ($4100 AUD)) including a reimbursement of up to one thousand Australian Dollars ($1000 AUD) for flights, travel and accommodation for customers residing outside of Victoria (hereinafter the "Grand Prize"; and 
• FIVE (5) sets of TWO (2) grandstand passes to The Fangio Stand (2-day pass) for Saturday the 1st of April (01/04/2023) and Sunday the 2nd of April 2023 (02/04/2023) at the Melbourne Grand Prix (valued at approximately nine hundred and twenty Australian Dollars ($920 AUD) per set) (hereafter collectively referred to as the "Minor Prize").

The total maximum prize pool is valued at approximately nine thousand seven hundred Australian Dollars ($9700 AUD).

General conditions/restrictions with respect to the prize:

• The Minor Prize does not include any flights, travel and/or accommodation.
• The reimbursement of flights, travel and/or accommodation for the winner of the Grand Prize will be made after the winner has provided proof of booking flights, travel and/or accommodation in the form of a receipt, order confirmation, booking confirmation or tax invoice. The reimbursement will be processed no less than five (5) business days after proof has been provided (this timeframe does not include the processing time of the sending or receiving bank, this timeframe is variable and out of the control of the Organizer).
• A Participant can win a maximum of ONE (1) prize in this SKIP THE LINE ORDER ONLINE F1.
• A prize can only be awarded to the winner of the SKIP THE LINE ORDER ONLINE F1 and is therefore not transferable (including any sale) to any other person.
• The prize may not be exchanged or converted into cash in any way whatsoever through any channel.
• The images used to describe the prize are for reference only. The final prize, namely the ones which the winners will actually receive, might look slightly different.
• In the event that unforeseen circumstances or circumstances beyond the Organizer’s control would make the delivery of the prize practically impossible, the Organizer reserves the right to award another equivalent prize to the winner(s) concerned. In such a case, the winner(s) will be notified of this change of prize by email or telephone. Any such change of prize shall not entitle the concerned winner to any compensation or indemnity.

In total there will be SIX (6) winners.

A winner is a Participant who:

• Cumulatively meets all the conditions of the SKIP THE LINE ORDER ONLINE F1 within the period specified in Article 4; and
• Has been designated as a winner by the random draw executed by the Organizer.

The draw will take place no later than March 17th, 2023 (17/03/2023) at the registered office of TVH Australia (735 Boundary Road, Richlands, Queensland 4077, Australia).

The SIX (6) winners will be notified directly by the Organizer in writing via email no later than March 17th 2023 (17/03/2023) at 11:00 AM AEST in order to confirm the fact that they won the prize and to arrange the delivery of the prize. All shipping costs are at the expense of the Organizer. Note: all arrangements in light of the handover of the prize need to be in line with all local, regional and national governmental regulations in light of the pandemic caused by COVID-19.

The winners will be published on https://www.tvh.com/en-au/about-tvh/company-news/skip-the-line-order-online-winners within thirty (30) days of the draw. The winners may also be announced via the Organizer’s Facebook and LinkedIn pages if applicable.

The result of the SKIP THE LINE ORDER ONLINE F1 is binding and irrevocable. The decision to designate winners is therefore final and can’t be contested.

If any prize remains unclaimed, an unclaimed prize draw will take place. This draw will take place fourteen (14) days after the initial draw (cf. above), namely on March 24th 2023 (24/03/2023), 11:00 AM AEST at the registered office of TVH Australia (735 Boundary Road, Richlands, Queensland 4077, Australia).

Any winners of the unclaimed prize draw will be notified directly in wiring via email no later than March 31st, 2023 (31/03/2023).

The winners of the unclaimed prize draw will be published on https://www.tvh.com/en-au/about-tvh/company-news/skip-the-line-order-online-winners within thirty (30) days of the draw.

The Organizer can't be held responsible or liable for:

• Not being able to deliver a prize if the Participant provided insufficient, incomplete or incorrect contact details.
• Possible damage, physical injury or accidents that could occur as a result of winning a prize and/or participating in the SKIP THE LINE ORDER ONLINE F1.
• Any shortcomings of the post and/or courier companies when delivering a prize (such as delay, damage, strike or loss).
• Any defect in the prize or if the prize doesn't meet the created expectations.
• Possible accidents or damage (in)directly related to a prize won.

The Organizer shall make every effort to allow access to the website and the SKIP THE LINE ORDER ONLINE F1 at any time. The Organizer may interrupt access to the website and the SKIP THE LINE ORDER ONLINE F1 at any time, in particular for technical reasons, updates and maintenance. Under no circumstances can the company be held liable for these interruptions and their consequences.

The Organizer reserves the right to modify, suspend or revoke/withdraw the SKIP THE LINE ORDER ONLINE F1 or its course at any time in any individual jurisdiction, if it is compelled to do so for legal reasons or if unforeseen circumstances or circumstances independent of the Organizer’s wish justify this, without any right to compensation or indemnification in respect of the Participants.

If amendments to the regulations are made, these will be communicated to the Participants by email. Any amendments are subject to the approval of the relevant state regulators.

These regulations are – depending on the organizing entity – subject to Australian and New Zealand law and will be implemented and interpreted in accordance with Australian and New Zealand law.

The Organizer will see to the proper course of the SKIP THE LINE ORDER ONLINE F1. All disputes concerning the application of these regulations shall be settled autonomously by the Organizer.

All personal data communicated by the Participants in connection with or within the framework of the SKIP THE LINE ORDER ONLINE F1 will be stored in a database managed by the Organizer. This personal data of the Participants is thus processed by the Organizer in accordance with its privacy policy, available on its website: https://www.tvh.com/privacy-policy. The Organizer shall respect the applicable privacy legislation.

By participating, Participants agree that if they win a prize, they may appear on the website and other channels (such as YouTube, Facebook ...) with their picture, name and address, as well as on the website and online channels of any co-organizers, and in the written press, as well as being filmed for (television) coverage of the Learning hub Play & Win.

This data can also be used for promotional campaigns or discounts, for information and studies.

You may at any time consult the personal data processed by the Organizer, have all necessary corrections made or ask the Organizer, free of charge, to remove them from its files or not to communicate all or part of the information obtained to third parties.
