WORLD CUP RUGBY TERMS & CONDITIONS

1. This disclaimer sets out the terms and conditions that apply to the Rugby World Cup Promotion organized by TVH Parts Holding NV (with registered office at Brabantstraat 15, 8790 Waregem, Belgium and with VAT number 0822.308.590) on behalf of itself and its affiliates and for TVH as well as Bepco customers (“TVH”).

More specifically, customers from the following regions can participate in this commercial 

campaign (see participating regions / countries in Annex 1): 

• For TVH customers: France, META, DACHIME, Italy, UK/Ireland, Eastern Europe, Oceania; 
• For Bepco customers: France, Afrimed, UK/Ireland.

By participating in the Rugby World Cup Promotion, the customer accepts, without reservation or restriction, all provisions of this Disclaimer and the decisions of TVH. The customer additionally recognizes that all purchases are subject to the TVH’s General Terms and Conditions of Sale, as available on its website: https://www.tvh.com/terms-condition. or https://www.bepcoparts.com/en-be/terms-conditions. 

2. Customers can receive foam fingers by placing an order of at least one hundred and fifty euros (€ 150,00) (or local currency equivalent cf. below in Article 6) ) or a rugby ball by placing an order of at least two hundred and fifty euros (€ 250,00) (or local currency equivalent) (hereafter collectively the “Gift(s)”) on all products from TVH’s online shop. 
3. The Gifts are attributed to the customers on a “first come, first served” basis and as long as stock lasts. A total of four thousand three hundred and sixty (4.360) Gifts will be attributed to customers (see number of gifts per region in Annex 1). Please note that for customers located in Oceania, the Rugby World Cup Promotion is limited in scope. Customers located in Oceania can only receive a rugby ball when reaching the minimum order amount (cf. Article 6, b, (iv)). No foam fingers shall be distributed amongst customers located in Oceania.
4. The Rugby World Cup Promotion is only valid on new orders placed by customers as from 08/09/2023 at 09:00 AM until 09/10/2023 at 17:00 PM (CET / GMT +1) or as long as the stock of the Gift lasts.
5. TVH shall make every effort to allow access to TVH’s online shop at any time. However, TVH may interrupt access to TVH’s online shop at any time, in particular for technical reasons, updates and maintenance. Under no circumstances can TVH be held liable for these interruptions and their consequences.
6. Customers can receive a maximum of one (1) Gift per order, meaning (or/or):
   1. one (1) foam finger as from the moment the minimum order amount is reached
      1. for Participants located in the UK/Ireland: one hundred and fifty pounds sterling (GBP £ 150,00) excl. VAT
      2. for Participants located in the EU: one hundred and fifty euros (€ 150,00) excl. VAT
      3. for Participants located in Southern Africa: three hundred rand (ZAR R 3000,00) excl. VAT
      4. for Participants located in Africa (except Southern Africa): one hundred and fifty euros (€ 150,00) excl. VAT
   2. one (1) rugby ball as from the moment the minimum order amount is reached. 
      1. for Participants located in the UK/Ireland: pounds sterling (GBP £ 250,00) excl. VAT
      2. for Participants located in the EU: two hundred and fifty euros (€ 250,00) excl. VAT
      3. for Participants located in Southern Africa: five hundred rand (ZAR R 5.000,00) excl. VAT
      4. for Participants located in Africa (except Southern Africa): two hundred and fifty euros (€ 250,00) excl. VAT  
7. Images of the Gift published by TVH are for reference purposes only.  The Gift, the ones the customers will actually receive, might look slightly different.
8. It is not allowed for the customer to transfer (including any sale) the Gift to any other person or company. The Gift may not be exchanged or converted into cash in any way whatsoever through any channel.
9. TVH will automatically send the gift to the customer, together with the ordered products if the customer has ordered products for a minimum purchase value as mentioned above in Article 6. 
10. TVH cannot be held responsible or liable for (i) not being able to deliver a Gift if the customer provided insufficient, incomplete or incorrect contact details; (ii) possible damage, physical injury or accidents that could occur as a result of receiving the Gift, (iii) any shortcomings of the post and/or courier companies when delivering the Gift (such as delay, damage, strike or loss); (iv) any defect in the Gift or if it doesn't meet the created expectations; (v) possible accidents or damage (in)directly related to a Gift received.
